Selling My Home/Property

WHAT ARE MY RESPONSIBILITIES WHEN SELLING MY SMOKY FALLS HOME?

When you sell your home or property in Smoky Falls, you may place one (1) realty sign no larger than 18X24 inches on the property only. You are required to contact the Smoky Falls POA Board of new ownership and the new owner's contact info. A $500 Property Notification Fee will apply if you do not. Property owners selling their property must include a copy of the By-laws in the deed and notification that new property owner(s) are required to become a Smoky Falls POA member.

Properties For Sale

CAN A PROPERTY OWNER LIST A PROPERTY FOR SALE ON WEBSITE?

If you are a Smoky Falls property owner, and would like to list a property you own in Smoky Falls, you may send the information to the Smoky Falls POA Board for listing on this website. All listings must be approved by the Board. You may send copies of Realtor listings, and include any links to the listing. You must notify the Board when the property has been sold or the listing has been removed or you will be charged a $500 Property Notification Fee.

Loose Dogs on the Mountain

WHAT SHOULD I DO IF I SEE A LOOSE DOG(S) RUNNING AROUND ON THE MOUNTAIN, OR HEAR A DOG(S) BARKING INCESSANTLY?

Sometimes hunting dogs get lost from their owners, or sometimes a dog may escape from their home/cabin. It’s never a good idea to approach a dog you do not know, especially one running around loose up in the mountains. The best thing to do is call the HAYWOOD ANIMAL CONTROL at 828.456.5338 and choose OPTION 7 to file a report/complaint. The SFPOA Board does not handle cases like this and are solely responsible for maintaining the roads within Smoky Falls.

Household Garbage Disposal and Recycling

WHERE SHOULD I BRING MY GARBAGE AND RECYCLING?

Smoky Falls does not have waste pick-up service. It is up to you to dispose of your household garbage and recycling. Please do NOT place your garbage outside of your cabin/ome as it will attract bears and other wildlife. The closest garbage center is MAUNEY COVE located at 30 Mauney Cove Road, Waynesville, NC 28786. The center is open 7am to 5pm Monday-Saturday and closed on Sunday. The number is 828.627.8042. The site has compactors for waste and recycling drop off. Oil, batteries and scrap metal are also accepted. Tires, commercial and medical waste are not accepted.

Road Maintenance

DOES THE SMOKY FALLS POA FEE INCLUDE TRIMMING THE SIDES OF ROADS?

No, the POA fee does not include trimming bushes, limbs, or foliage from the sides of the road. Fees cover maintenance of hard-surfaced roads within Smoky Falls, including existing roads graded by the developer. Maintenance includes: mowing roadsides, ditch clearing, removing fallen trees prohibiting access, and grading/graveling on an “as needed” basis. Community Activity days will be designated for owners to come out and trim areas of the roads together. Owners are expected to trim their respective side of the road & driveway.

Annual Membership Dues

WHEN ARE THE ANNUAL MEMBERSHIP FEES DUE?

Smoky Falls Property owners will pay a $350 Annual Membership Fee, and Homeowners will pay a $450 Annual Membership Fee. These fees are due annually on July 1st, and the final deadline is July 15th. If any membership dues, account, or assessments remain unpaid for ninety (90) days, all rights and privileges of the Smoky Falls POA membership will be suspended. Continuance of non-payment will result in a lien being placed on the member’s property. (Article VII, Sec. 4)

Non-refundable Impact Fee

WHAT IS THE NON-REFUNDABLE IMPACT FEE AND WHAT DOES IT GO TOWARDS?

Any owners making a driveway in Smoky Falls will be considered to be starting new construction, and will be responsible to pay a non-refundable Impact Fee of $1,000 (one-thousand dollars). This will be due at the time the driveway is started. The fee will go towards road maintenance to cover the damage to the roads that will be caused by water runoff from driveways, followed by expenses incurred by trucks and other equipment used to create the driveway. The roads throughout Smoky Falls consists of gravel, which is a combination of many small stones and rocks. For this reason, issues with a gravel roadway on a steep slope is that gravity, weather and heavy traffic tends to act on loose gravel, sending it tumbling downwards.

ATV and UTV Use

ARE THERE RULES AND REGULATIONS I SHOULD FOLLOW WHEN RIDING MY ATV/UTV?

For safety reasons, drivers of ATVs, UTVs, motorcycles, dirt bikes, etc. on Smoky Falls Roads must be at least sixteen (16) years old and have a valid driver's license, or be accompanied by an adult. In North Carolina, you may not operate an ATV/UTV on any interstate or highway or on any other public street, road, or highway except for purposes of crossing that street, road, or highway. It is unlawful to operate an ATV/UTV under the influence of alcohol/drugs, or in a manner that damages/destroys public/private property, trees, crops, or lands belonging to another person. Please drive slow and watch for wildlife.
